Terms & Conditions

1. Who you are contracting with

EnzelScale (the “Service”) is provided by ENZELL DIGITAL ADVERTISING SERVICES (“we”, “us”, “our”), trading as EnzelScale. These Terms form a binding agreement between you and ENZELL DIGITAL ADVERTISING SERVICES.

2. Acceptance

By creating an account, purchasing a plan, or continuing to use the Service you agree to these Terms. If you are using the Service on behalf of an organisation you confirm you have authority to bind it; otherwise you confirm you are of legal age in your country.

3. The Service

EnzelScale is a software-as-a-service application for worship musicians. It provides chord charts, lyric and vocal cue tools, setlist management, a tuner, soundboard, player, a Bible reader, a gear classifieds board and self-serve promotion tools. Features available to you depend on your plan (Basic, Pro or Premium). We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

What we sell. The only things you can purchase from us are digital software subscriptions to EnzelScale (Pro and Premium) and self-serve digital promotion add-ons inside our own app — ADSdi placements and Artist Spotlight slots, which display your creative on EnzelScale surfaces only. We do not resell third-party media or advertising inventory, and we sell no physical goods.

Marketdi is classifieds only. Marketdi lets users publish listings for their own gear. We are not a marketplace operator, agent, broker, escrow or payment intermediary: we do not sell the listed items, process payments for them, hold funds, or handle shipping, delivery, returns or disputes between users. Buyers and sellers deal with each other directly and off-platform, at their own risk.

4. Your account

You must provide accurate information and keep it current. You are responsible for keeping your credentials confidential and for all activity under your account. Tell us immediately if you suspect unauthorised access.

5. Acceptable use

You may use EnzelScale only for lawful worship, music and business purposes permitted by these Terms. You must not misuse the Service. Misuse includes, without limitation, any unlawful use, fraud or spam, infringement of intellectual property rights, and any interference with the security or integrity of the Service. The following activities are strictly prohibited.

Prohibited conduct

  • Unlawful use: any activity that breaches applicable laws, sanctions or regulations, or that facilitates illegal acts;
  • Fraud and spam: fraud, phishing, money laundering, deceptive pricing, chargeback abuse, spam or unsolicited bulk messaging;
  • Intellectual property infringement: copying, uploading, performing, distributing or selling any chord chart, lyric, PDF, recording, artwork or software you do not own or have permission to use, or removing copyright notices;
  • Security interference: introducing malware or malicious code, probing, scanning or penetration testing, denial-of-service or load testing, scraping or automated bulk access, and circumventing authentication, rate limits, storage limits or plan limits;
  • harassment, threats, bullying, hate speech, or content that incites violence or discriminates against people based on race, ethnicity, religion, gender, sexual orientation, disability or other protected characteristics;
  • impersonating another person, artist, church or organisation, or misrepresenting affiliation;
  • reverse engineering, decompiling, reselling, sublicensing or redistributing the Service or sharing account credentials with people outside your account;
  • accessing another user’s account, data, uploads or private media without permission.

Prohibited content

  • content that infringes copyright, trademark, publicity or other rights — including chord charts, lyrics, PDFs, audio recordings or artwork you do not have the rights to upload or distribute;
  • sexually explicit, pornographic or child-endangering material;
  • extremist, terrorist or graphically violent material;
  • content promoting illegal drugs, weapons, gambling, counterfeit goods, pyramid schemes or other regulated or restricted items;
  • misleading marketplace listings, fake reviews, fake ratings, or advertising and Artist Spotlight submissions that are deceptive, defamatory or unrelated to the listed offer;
  • personal data of others shared without a lawful basis or their consent.

Moderation and enforcement

We may review, filter, restrict, remove or refuse any content or listing, and we may limit, suspend or terminate accounts for material breach, non-payment, security or fraud risk, or repeated or serious violations of this section — with or without notice where the risk is urgent. Rights-holders and users can report violations to support@enzelscale.com; repeat infringers lose access permanently.

6. Your content

You keep ownership of the songs, PDFs, audio, listings and other content you upload. You confirm you hold the rights needed to upload and use that content, and you grant us a limited licence to host, process and display it solely to operate the Service for you. Rights-holders may contact us to request a takedown, and we may remove content or suspend accounts for repeated infringement.

7. Our intellectual property

We retain all rights in the Service, including its software, design, branding and documentation. Nothing in these Terms transfers ownership to you.

8. Service availability

We work to keep the Service reliable, but we do not guarantee uninterrupted or error-free performance. Features may change, and maintenance or third-party outages may interrupt access.

9. Payments and subscriptions

All purchases are digital. Plans are sold as monthly or yearly software subscriptions and renew automatically until cancelled. ADSdi placements and Artist Spotlight slots are fixed-term digital promotion add-ons within EnzelScale. No payment for gear listed on Marketdi is ever taken through EnzelScale or Paddle. Payment, billing, taxes, invoicing, cancellation and refund mechanics are handled by Paddle and governed by the Paddle Checkout Buyer Terms. See our Refund Policy for our refund window.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

10. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time; access continues until the end of your paid period. After termination we may delete your content after a reasonable export window.

11. Warranties and liability

To the fullest extent permitted by law, the Service is provided “as is” and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

12. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

13. General

You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These Terms are governed by the laws of the United Arab Emirates, and the courts of Dubai have exclusive jurisdiction, without limiting mandatory consumer rights in your country of residence.
